Ukoliko nisu navedeni svi zahtevani podaci, Korisnik neće biti u mogućnosti da izvrši porudžbinu. | If all required data are not provided, the User will not be able to place an order. |

Nijedan ugovor o kupoprodaji bilo kog proizvoda ne postoji dok Trgovac izričito ne prihvati porudžbinu (bez obzira na to da li su sredstva skinuta sa računa Korisnika/Kupca). Ukoliko Trgovac ne prihvati ponudu, odnosno odbije porudžbinu, a sredstva budu skinuta, sredstva će Korisniku biti u potpunosti refundirana. | The information provided in Terms and Conditions and the information found on this website do not constitute an offer but an invitation to make an offer. Kako bi Korisnik izvršio porudžbinu, potrebno je da sledi postupak onlajn kupovine i da klikne na „Odobri plaćanje”. Nakon toga Korisnik će od Trgovca zaprimiti e-mail sa potvrdom porudžbine u celosti ili delimično, u zavisnosti od konkretnih okolnosti poput raspoloživosti naručenog proizvoda i sl. („Potvrda porudžbine”). Korisnik će biti obavešten putem e-maila da je porudžbina prihvaćena i poslata („Potvrda slanja”). Uz Potvrdu slanja Trgovac će priložiti i elektronsku potvrdu sa informacijama o porudžbini („elektronska potvrda“). | In order for the User to complete the order, it is necessary to follow the online purchase procedure and to click on „Approve payment“. Prethodne radnje predstavljaju međusobni sporazum izmedju Trgovca/Prodavca i Korisnika/Kupca u pisanom obliku. Ugovor o kupoprodaji na daljinu zaključen je momentom prispeća Potvrde porudžbine. Ugovor o kupoprodaji pored Potvrde porudžbine i Potvrde slanja obuhvata i ove Opšte uslove. | The previous actions represent a mutual agreement between the Merchant/Seller and the User/Buyer in written form. The distance sales contract is concluded upon receipt of the Order Confirmation. 7. DOSTUPNOST PROIZVODA, UKLANJANJE PROIZVODA SA VEB-SAJTA I ODBIJANJE OBRADE PORUDŽBINE | 7. PRODUCT AVAILABILITY, REMOVAL OF PRODUCTS FROM THE WEBSITE AND REFUSAL OF ORDER PROCESSING |
Svi proizvodi istaknuti na veb-sajtu sa podložni promeni dostupnosti. Trgovac zadržava pravo na uklanjanje proizvoda sa ovog veb-sajta u svakom trenutku, kao i na uklanjanje ili izmenu materijala ili sadržaja sa veb-sajta. Trgovac će nastojati da obradi sve porudžbine, no usled vanrednih okolnosti Trgovac zadržava pravo da odbije obradu porudžbine. Za uklanjanje proizvoda sa veb-sajta Trgovac nije odgovoran Korisniku veb-sajta niti kojoj trećoj strani. | All products featured on this website are subject to change in availability. 8. ISPORUKA | 8. DELIVERY |
Trgovac se obavezuje da robu isporuči u roku od 5 radnih dana od dana slanja Kupcu Potvrde porudžbine, a ukoliko Trgovac nije u mogućnosti da robu isporuči u navedenom roku, obavezuje se da je dostavi Kupcu u roku od 30 dana od dana Potvrde porudžbine, osim u slučaju nemogućnosti isporuke iz odeljka 9. ovih Opštih uslova. Ukoliko nakon Potvrde porudžbine, a pre isporuke robe nastane događaj koji se smatra višom silom, Trgovac se obavezuje da pošalje Kupcu obaveštenje o kašnjenju sa upitom o saglasnosti o produženju roka isporuke i ostanka ugovora na snazi, a što je sve detaljno objašnjeno u odeljku 19. Opštih uslova. | The Merchant undertakes to deliver the goods within 5 working days from the day of sending the Order Confirmation to the Buyer, and if the Merchant is unable to deliver the goods within the specified term, he undertakes to deliver the goods to the Buyer within 30 days from the day of the Order Confirmation, except in a case of impossibility of delivery from section 9 of these Terms and Conditions. Trgovac se obavezuje da robu fizički preda Kupcu. Kupac se obavezuje da robu preuzme, na adresi navedenoj prilikom pravljenja porudžbine na veb-sajtu (“Porudžbenica”) i u vreme dogovoreno sa kurirskom službom koja će izvršiti isporuku robe. | The Merchant undertakes to hand over the goods physically to the Buyer. The Buyer undertakes to take over the goods, on address stated while placing an order on the website (“Order Form”) and in time agreed with the courier service which shall make the goods delivery. |

Je isporučena na adresu koju je Potrošač označio prilikom popunjavanja Porudžbenice; | It was delivered to the address indicated by the Costumer when filling out the Order Form; |
Je dostavljena u pakovanju koje se smatra uobičajenim za tu vrstu i količinu stvari, kao i za stvari istih karakteristika; | It was delivered in a packaging which is deemed as customary for the type and amount of goods, as well as for the items of the same charachteristics; |
Je isporučena u roku u skladu sa ovim Opštim uslovima; | It was delivered in a timely manner in accordance with these Terms and Conditions; |
Je isporučena stvar u opisu datom na veb-sajtu Trgovca, odnosno u skladu sa Ugovorom; | The item was delivered in accordance with the description given on the Merchant’s website, i.e. in accordance with the Agreement/Contract; |
Je isporučena stvar neoštećena, odnosno bez fizičkih i pravnih mana. | The delivered item was undamaged, i.e. without physical and legal defects. |
U slučaju dostave vikendom i praznicima, odnosno neradnim danima, primenjivaće se politika poslovanja kurirske službe sa kojom Trgovac sarađuje. Trgovac se obavezuje da robu isporuči u prigodnom pakovanju. Ukoliko se tokom transporta ošteti pakovanje, ali roba ostane neoštećena, ne smatra se da roba ima fizičke mane. | In case of delivery on weekends and holidays, i.e. on non-working days, the business policy of the courier service with which the Merchant cooperates shall apply. The Merchant undertakes to deliver the goods in appropriate packaging. If the packaging is damaged during transport, but the goods remain undamaged, the goods are not considered to have physical defects. |
Smatra se da je isporuka izvršena u momentu kada Kupac preuzme stvar na adresi označenoj u porudžbenici i stavi svoj potpis na potvrdu o prijemu. | The delivery is deemed to have been made at the moment when the Buyer receives the item at the address indicated in the Order Form and puts his signature on the confirmation of receipt. |
Prodavac odgovara za materijalne nedostatke stvari bez obzira na to da li su mu isti bili poznati. Prodavac odgovara i za one materijalne nedostatke koji se pojave posle prelaza rizika na Kupca ako su posledica uzroka koji je postojao pre toga. Kupac se obavezuje da primljenu stvar odmah pregleda i da o eventualnim materijalnim nedostacima obavesti Prodavca u roku od 8 dana od prijema stvari, u suprotnom, Prodavac neće odgovarati za materijalne nedostatke. U slučaju da se pojavi skriveni nedostatak stvari, odnosno nedostatak koji se pri normalnom pregledu stvari nije mogao uočiti, Kupac ima pravo da u roku o 8 dana od dana kada je uočio skriveni nedostatak, ali ne kasnije od 6 meseci od prijema stvari, prijavi nedostatak Prodavcu. Ukoliko Kupac postupi na navedeni način i u navedenim rokovima, Prodavac odgovara za skriveni nedostatak. | The Seller is liable for material defects of the item regardless of whether they were known to him. The Seller is also responsible for those material defects that appear after the risk transfer to the Buyer if they are the result of a cause that existed before that. The Buyer undertakes to inspect the received item immediately and to notify the Seller of any material defects within 8 days of receiving the item, otherwise, the Seller will not be responsible for material defects. In the event that a hidden defect in the item appears, i.e. a defect that could not be observed during a normal inspection of the item, the Buyer has the right to report the defect within 8 days from the day he noticed the hidden defect, but no later than 6 months after receiving the item, to the Seller. If the Buyer acts in the specified manner and within the specified terms, the Seller is responsible for the hidden defect. |
9. NEMOGUĆNOST ISPORUKE | 9. IMPOSSIBILITY OF DELIVERY |
Ukoliko je nemoguće isporučiti robu na adresu označenu u porudžbenici, kurirska služba će obavestiti Kupca o mestu, roku i uslovima čuvanja robe, u skladu sa uslovima poslovanja kurirske službe. | If it is impossible to deliver the goods to the address indicated in the Order Form, the courier service will inform the Customer about the place, term and conditions for storing the goods, in accordance with the terms and conditions of the courier service. |
Ukoliko nastane neki od događaja koji se smatraju višom silom, a što je bliže definisano i objašnjeno u odeljku 19. Opštih uslova, postoji mogućnost da Prodavac neće moći da ispuni svoje ugovorne obaveze. U navedenim slučajevima Prodavac je oslobođen svake odgovornosti za neispunjenje svojih ugovornih obaveza. Obe ugovorne strane su ovlašćene da u slučaju nastanka okolnosti koje se smatraju višom silom zahtevaju raskid ugovora. U slučaju raskida ugovora iz prethodno navedenih razloga, svaka strana vrši povraćaj primljenog. Prodavac je u obavezi da refundira cenu Kupcu u roku od 14 dana od dana raskida ugovora, ukoliko ju je Kupac platio pre isporuke robe. | If any of the events considered as force majeure occur, as more closely defined and explained in section 19 of the Terms and Conditions, there is a possibility that the Seller will not be able to fulfill its contractual obligations. In the mentioned cases, the Seller is released from any responsibility for non-fulfillment of his contractual obligations. Both Parties are authorized to demand termination of the contract in the event of circumstances considered as force majeure. In the event of termination of the contract for the aforementioned reasons, each Party shall return what it received. The Seller is obliged to refund the price to the Buyer within 14 days from the date of termination of the contract, if the Buyer paid it before the delivery of the goods. |
U slučaju nemogućnosti isporuke, koja se ne smatra višom silom, a koju je skrivio Kupac, Kupac će snositi odgovornost, kao i sve prateće troškove. Za nemogućnosti isporuke, koju je skrivio Prodavac, Prodavac će biti odgovoran i snositi prateće troškove. | In case of the impossibility of delivery, which is not considered a force majeure, and which was the fault of the Buyer, the Buyer will bear the responsibility, as well as all associated costs. For impossibility of delivery, which was fault of the Seller, the Seller will be responsible and bear the associated costs. |
10. PRENOS RIZIKA I VLASNIŠTVA NA PROIZVODU | 10. TRANSFER OF RISK AND OWNERSHIP OF THE PRODUCT |
Kupac se obavezuje da stvar koju je poručio preuzme, odnosno primi od kurirske službe. Ukoliko Kupac ne postupi u skladu sa tim, na njega prelazi rizik slučajne propasti stvari i teret troškova čuvanja stvari, počev od poslednjeg dana čuvanja stvari kod kurirske službe, o čemu će biti obavešten. Navedene rizike Kupac snosi sve dok Prodavac ne preuzme stvar/robu od kurirske službe. | The Buyer undertakes to take over the item he ordered, i.e. to receive it from the courier service. If the Buyer does not act accordingly, the risk of accidental loss of the item and the burden of the costs of storing the item will be transferred to him, starting from the last day of storing the item at the courier service, of which he will be informed. The stated risks are borne by the Buyer until the Seller takes over the item/goods from the courier service. |
Ukoliko nastane događaj koji se smatra višom silom, rizik slučajne propasti i teret snošenja troškova čuvanja stvari snosi vlasnik stvari, a to je: | If an event that might be considered as force majeure arises, the risk of accidental loss and the burden of bearing the costs of keeping the item is borne by its owner, which is: |
Do momenta kada Kupac preuzme stvar od kurirske službe – Prodavac; | Until the moment the Buyer collects the item from the courier service – the Seller; |
Ukoliko Kupac ne preuzme tokom perioda čuvanja stvari kod kurirske službe i stvar se vrati Prodavcu – Kupac od poslednjeg dana čuvanja do preuzimanja stvari od strane Prodavca; | If the Buyer does not pick up the item during the storage period with the courier service and the item is returned to the Seller – the Buyer from the last day of storage until the item is picked up by the Seller; |
U slučaju reklamacije – Prodavac od trenutka preuzimanja u državinu stvari radi ispitivanja osnovanosti izjavljene reklamacije do trenutka vraćanja stvari u državinu Kupca, a u skladu sa tačkama 1 i 2 iznad; | In case of a complaint – the Seller from the moment of taking over the item into his possession for the purpose of examining the validity of the filed complaint until the moment of returning the item to the Buyer’s possession, in accordance with points 1 and 2 above; |
Od momenta preuzimanja stvari u državinu od kurirske službe – Kupac. | From the moment of taking over the item into his possession from the courier service – the Buyer. |
Ukoliko Kupac nije preuzeo stvar od kurirske službe u roku čuvanja, kao i ako nije platio cenu, ugovor se ima smatrati raskinutim. | If the Buyer has not collected the item from the courier service within the storage period, as well as if he has not paid the price, the contract shall be considered terminated. |
Vlasništvo nad stvari koja je predmet ugovora zasniva se fizičkom predajom. | Ownership of the item that is subject of the agreement is constituted by physical handover. |
11. CENA, PLAĆANJE I POREZ NA DODATU VREDNOST (PDV) | 11. PRICE, PAYMENT AND VALUE ADDED TAX (VAT) |
Cena proizvoda će u svakom trenutku biti navedena na KADU-ovom veb-sajtu na jasan, nedvosmislen i lako čitljiv način. KADU samostalno utvrđuje cene i druge komercijalne uslove za pružanje usluga i prodaju robe, u skladu sa svojom poslovnom politikom i ovim Opštim uslovima. | The product price shall, at any moment, be stated on the KADU website in a clear, unambiguous and easily legible manner. KADU determines the price and other commercial conditions for provision of services and selling of goods, in accordance with its business policy and these Terms and Conditions. |
Korisnik više detalja o samom proizvodu (detaljno prikazan sastav, dostupne veličine i sl.) i ostalim informacijama od značaja za njegovo donošenje odluke o tome da li će proizvod zaista i kupiti dobija klikom na konkretni proizvod. | The User gets more details about the product itself (detailed composition, available sizes, etc.) and other relevant information for making a decision on whether to actually buy the product by clicking on the specific product. |
KADU će u svakom trenutku nastojati da ima istaknute tačne cene na svom veb-sajtu. U slučaju greške u pogledu cene ili druge informacije o proizvodu koji Korisnik naruči, KADU će Korisnika obavestiti o navedenom što je pre razumno moguće, uz obrazloženje nastale greške, navođenja ispravne cene i pružanja mogućnosti Korisniku da potvrdi, odnosno prihvati takve uslove i nastavi sa porudžbinom ili otkaže porudžbinu. U slučaju otkaza, KADU će vratiti plaćen iznos Korisniku u celosti. | KADU will endeavor to display accurate prices on its website at all times. Korisnik treba da ima u vidu da će se samo proizvodi sa punom / redovnom cenom koja je navedena na veb-sajtu KADU-a uzeti u obzir, odnosno kvalifikovati za dostizanje potrebnog praga za isporuku bez dodatne naknade za dostavu. Kada Korisnik odabere sve artikle koje želi da kupi, oni će se dodati u korpu. Kada Korisnik klikne na korpu, sledeći korak je obrada porudžbine (pristup na virtuelnu kasu – checkout) i njeno plaćanje. U tu svrhu, Korisnik je dužan da prati korake za realizaciju kupovine, navodeći ili potvrđujući informacije koje se zatraže u svakom koraku. Naplata na Korisnikovoj platnoj kartici i skidanje sredstava sa iste će biti izvršeno kada se porudžbina potvrdi. | When the Merchant receives the User’s order, the preauthorization on the User’s card shall be required in order to perform the safe check whether there are available funds to make the transaction. The charge to the User’s payment card and the withdrawal of funds will be made when the order is confirmed. |

Sva plaćanja biće izvršena u lokalnoj valuti Republike Srbije, u dinarima (RSD). Za informativni prikaz cena u drugim valutama koristi se srednji kurs Narodne Banke Srbije. Iznos za koji će biti zadužena Korisnikova platna kartica biće izražen u Korisnikovoj lokalnoj valuti kroz konverziju u istu po kursu koji koriste Izdavaoci kartica, a koji Trgovcu u trenutku transakcije ne može biti poznat. Kao rezultat ove konverzije, postoji mogućnost neznatne razlike od originalne cene navedene na sajtu KADU-a. | All payments shall be made in a local currency of the Republic of Serbia, in dinars (RSD). For an informative overview of prices in other currencies, the middle exchange rate of the National Bank of Serbia is used. U slučaju vraćanja robe i povraćaja sredstava Korisniku koji je prethodno platio nekom od platnih kartica, delimično ili u celosti, a bez obzira na razlog vraćanja, KADU je u obavezi da povraćaj vrši isključivo preko VISA, EC/MC i Maestro metoda plaćanja, što znači da će banka na zahtev KADU-a obaviti povraćaj sredstava na račun korisnika platne kartice. U slučaju povraćaja sredstava, primenjuju se odredbe Opštih uslova iznad koji se tiču eventualne razlike u iznosu refundiranih sredstava, kao i druge odredbe Opštih uslova. | In case of returning goods and refunds to a User who previously paid with one of the payment cards, partially or in full, and regardless of the reason for the return, KADU is obliged to make the refund exclusively via VISA, EC/MC and Maestro payment methods, which means that at the request of KADU, the bank will refund the funds to the account of the payment card user. Korisnik je, stoga, u obavezi da po isteku uobičajenog roka za prijem predračuna ili računa obavesti KADU o izostanku i zatraži ponovno slanje, odnosno slanje duplikata. | KADU bears no responsibility in case that the User does not receive the Pro-forma invoice or the invoice in a timely manner (due to malfunction on the User’s web, force majeure and the like). The User is, consequently, obliged to inform KADU of the absence and request resending, i.e. sending a duplicate, after the expiry of the usual deadline for receipt of the Pro-forma invoice or invoice. |

13. PRAVILA ZAMENE/POVRAĆAJA | 13. CHANGE/RETURN RULES |
13.1 Zakonsko pravo na odustajanje od kupovine/odustanak od ugovora | 13.1 Legal Right to Withdraw From the Purchase/Withdrawal From the Contract |
Kupac ima pravo da bez navođenja razloga odustane od ugovora u roku od 14 dana počev od dana zaključenja ugovora između Kupca i Trgovca. U slučaju odustanka od ugovora Kupac nije dužan da navede razlog odustanka od ugovora niti je dužan da snosi troškove dostave, osim u slučaju izričitog zahteva Kupca za dostavu koja odstupa od najjeftinije uobičajene dostave koju je ponudio Trgovac. | The Buyer is entitled to withdraw from the contract without giving any reason within 14 days from the day of conclusion of the contract between the Buyer and the Merchant. In case of withdrawal from the contract, the Buyer is not obliged to state the reason for the withdrawal from the contract, nor is he obliged to bear the delivery costs, except in the case of the Buyer’s express request for delivery that deviates from the cheapest usual delivery offered by the Merchant. |
Kupac ostvaruje pravo na odustanak od ugovora izjavom koju daje na propisanom obrascu za odustanak od ugovora (u daljem tekstu – Izjava o odustanku), koju je Trgovac u obavezi da Kupcu dostavi prilikom realizacije ugovora o prodaji robe na daljinu, zajedno sa Ugovorom o prodaji robe na daljinu i računom. Trgovac može da odloži povraćaj sredstava dok ne dobije robu koja se vraća, ili dok Kupac ne dostavi dokaz da je poslao robu Trgovcu. | In case of withdrawal from the contract by the Buyer, the Merchant is obliged to return the funds received in the same way as the transaction was carried out, within 14 days from the date of withdrawal from the contract – receipt of the written Declaration of Withdrawal. The Merchant may delay the refund until receiving the goods to be returned, or until the Buyer provides proof that it has sent the goods to the Merchant. |
Trgovac nije u obavezi da izvrši povraćaj novčanih sredstava u slučaju kada je roba koja je predmet ugovora o prodaji na daljinu (roba koja se vraća) korišćena nakon otvaranja, u slučaju kada roba nije u stanju u kojem je isporučena i u slučaju kada je roba oštećena. U slučaju odustanka od ugovora Kupac je dužan da robu vrati preko kurirske službe preko koje je izvršena dostava Kupcu. Radi realizacije povrata robe putem kurirske službe preko koje je izvršena dostava od strane Trgovca, Kupac je dužan da se obrati Trgovcu na e-mail adresu kadureklamacije@gmail.com u cilju dogovora u vezi sa preuzimanjem robe. | In case of withdrawal from the contract, the Buyer is obliged to return the goods via the courier service through which the delivery was made to the Buyer. In order to realize the return of goods through the courier service through which the delivery was made by the Merchant, the Buyer is obliged to contact the Merchant at the e-mail address kadureklamacije@gmail.com in order to agree on the collection of the goods. |
U slučaju da Kupac odabere da povraćaj robe izvrši na drugi način, a ne na način iz prethodnog stava, Kupac snosi troškove povraćaja robe. Trošak povrćaja robe će biti naplaćen na način što će se odbiti od iznosa koji je Trgovac dužan da nadoknadi Kupcu kao posledicu odustanka od ugovora. | In the event that the Buyer chooses to return the goods in a different way than in the way from the previous paragraph, the Buyer bears the costs of returning the goods. Ukoliko Prodavac prodaje proizvod sa nedostatkom, dužan je da taj proizvod izdvoji od drugih proizvoda, da smanji cenu proizvoda u zavisnosti od vrste i obima nedostatka i da upozori Kupca na te nedostatke. Prodavac je dužan da na proizvodu sa nedostatkom istakne jasno i vidljivo obaveštenje o sniženoj ceni, o nedostatku proizvoda i o isključenju odgovornosti Prodavca za taj nedostatak. | If the Seller sells a product with a defect, he is obliged to separate that product from other products, to reduce the price of such product depending on the type and scope of the defect and to warn the Buyer on those deficiencies. The Seller is obliged to highlight a clear and visible notice on the product with a defect about the reduced price, about the product’s specific defect and about the exclusion of the Seller’s responsibility for that defect. |

Potrošač prihvata i saglasan je da sva autorska prava, registrovani žigovi / logoi, oznake i druga prava intelektualne svojine koji se nalaze na svim materijalima, proizvodima, robi ili sadržaju na ovom veb-sajtu, a sa kojima Potrošač dođe u kontakt predstavljaju isključivu svojinu KADU-a u svakom trenutku ili trećih lica koja su KADU-u dala saglasnost, odnosno dozvolu za njihovu upotrebu. Navedene materijale, odnosno prava, Potrošač može koristiti isključivo u meri u kojoj KADU ili treća lica kao davaoci dozvole za korišćenje izričito navedu. Potrošač ne sme KADU-ov veb-sajt koristiti na neprikladan i štetan način namernim unošenjem (neposredno ili preko trećih lica) virusa, Trojanaca, računarskih crva, logičkih bombi ili bilo kog drugog softvera, malvera ili tehnološki štetnog materijala. Zabranjen je neovlašćen pristup veb-sajtu, serveru na kom se stranica nalazi ili bilo kom serveru, računaru ili bazi podataka koji su povezani sa veb-sajtom KADU-a. Korišćenjem ovog veb-sajta Potrošač daje saglasnost da se međusobna komunikacija odvija elektronskim putem (e-mailovima, slanjem SMS poruka kada je to prikladno – npr. radi relizacije dostave, kao i putem drugog trajnijeg medijuma koji može da skladišti saopštene informacije), osim u slučajevima kada pozitivni propisi izričito propisuju pisanu formu komunikacije, u kom slučaju se komunikacija i druge radnje između KADU-a i Potrošača preduzimaju i odvijaju pisanim putem, slanjem preporučenih pisama na relevantne adrese. KADU će se, u velikoj većini slučajeva, obraćati Potrošaču putem e-maila ili će pružati neophodne informacije objavljivanjem obaveštenja na veb-sajtu. Potrošač je saglasan sa upotrebom elektronskih vidova komunikacije i prihvata da su svi ugovori, obaveštenja, informacije i druga komunikacija koju KADU šalje elektronskim putem punovažni i u skladu sa pozitivnim propisima Republike Srbije, odnosno da je uslov pisane forme zadovoljen u ovom slučaju, osim u slučajevima gde je pisana komunikacija izričito propisana. Navedeni prenosi, ustupanja, davanja ili drugi transferi neće uticati na prava koja, po zakonu ima Potrošač, niti na bilo koji način otkazati, smanjiti ili ograničiti izričite i podrazumevane garancije. | Seller may transfer, assign, grant, subcontract or otherwise transfer the Agreement or any of the rights or obligations arising from the Agreement at any time during the term of the Agreement. The stated transfers, assignations, grants or other transfers shall not affect the rights that the Consumer has under the Law, nor it shall in any other way disclaim, reduce or limit the express and implied guarantees. |

19. VIŠA SILA | 19. FORCE MAJEURE |
KADU nije odgovoran za neispunjenje ili kašnjenje u ispunjenju (u celini ili delimično) obaveza koje su prihvaćene prema Ugovoru ukoliko je ono nastalo usled događaja koji su izvan razumne kontrole KADU-a, odnosno koje KADU nije mogao razumno predvideti i sprečiti, kontrolisati ili izbeći („Viša sila„). | KADU is not responsible for non-fulfilment or delay in fulfillment (in whole or in part) of the obligations accepted under the Agreement if it was caused by events beyond the reasonable control of KADU, i.e. which KADU could not have reasonably foreseen and prevented, controlled or avoided („Force Majeure„). |
Shodno gorenavedenom, Viša sila obuhvata svaki čin, događaj, neuspešno izvršavanje, propust ili nesreću koja je izvan razumne kontrole KADU-a, uključujući, ali ne ograničavajući se na, sledeće: | In accordance with the abovementioned, the Force Majeure entails every act, event, failure of performance, omission or accident beyond KADU’s reasonable control, including but not limited to the following: |
Štrajk, zatvaranje ili druge oblike protesta; | Strike, lockout or other froms of protest; |
Građanske nemire, pobune, terorističke napade ili pretnje, rat (objavljen ili neobjavljen) ili pretnju rata ili pripremu za rat; | Civil unrest, riots, terrorist attacks or threats, war (declared or undeclared) or threat of war or preparation for war; |
Požare, oluje, poplave, potrese, suše, kolapse, zemljotrese, epidemije ili druge prirodne i zdravstvene katastrofe; | Fires, storms, floods, earthquakes, droughts, collapses, epidemics or other natural and health disasters; |
Nemogućnost korišćenja železničkog, brodskog, vazdušnog ili motornog saobraćaja ili drugih transportnih sredstava, javnih ili privatnih; | Impossibility of using rail, ship, air or motor transport or other means of transport, public or private; |
Nemogućnost korišćenja javnih ili privatnih telekomunikacionih sistema; | Impossibility of using public or private telecom systems; |
Uredbe, dekrete, zakone, propise ili ograničenja bilo koje vlade ili organa vlasti; | Regulations, decrees, laws or restrictions of any government or authority; |
Štrajk, kvar ili nesreću u morskom ili rečnom saobraćaju, poštanskom saobraćaju ili drugoj vrsti saobraćaja. | Strike, malfunction or accident in sea or river traffic, postal traffic or other type of traffic. |
Usled nastanka događaja Više sile, KADU će obavestiti Potrošača o njenom nastanku u pisanom obliku što je pre moguće, a najkasnije u roku od 15 dana od dana prestanka okolnosti Više sile ukoliko obaveštenje nije bilo moguće dostaviti Potrošaču tokom trajanja Više sile. Obaveze KADU-a koje proizlaze iz Ugovora obustavljaju se tokom perioda trajanja Više sile, te se rok za ispunjenje obaveza od strane KADU-a produžava za period koji je jednak periodu trajanja Više sile. KADU će preduzeti sve razumne mere i obezbediti sve razumne resurse kako bi se događaj Više sile prevazišao, otklonio ili kako bi se pronašlo rešenje koje omogućava KADU-u da ispuni svoje obaveze prema Ugovoru uprkos okolnosti Više sile. | Due to the occurrence of a Force Majeure event, KOTON will inform the Consumer about its occurrence in writing as soon as possible, and no later than within 15 days from the end of the Force Majeure event, if the notification could not be delivered to the Consumer during the duration of the Force Majeure event. The obligations of KADU arising from the Agreement are suspended during the duration of Force Majeure, and the deadline for the fulfillment of obligations by KADU is extended for a period equal to the duration period of Force Majeure. KADU will take all reasonable measures and provide all reasonable resources in order to overcome the Force Majeure event, eliminate it or to find a solution that allows KADU to fulfill its obligations under the Agreement despite the Force Majeure circumstances. |
20. ALTERNATIVNO, ODNOSNO VANSUDSKO REŠAVANJE POTROŠAČKIH SPOROVA | 20. ALTERNATIVE DISPUTE RESOLUTION, I.E. OUT-OF-COURT SETTLEMENT OF CONSUMER DISPUTES |
Ukoliko Potrošač nije zadovoljan robom, odnosno isporukom robe iz nekog od navedenih razloga u odeljku 13. pododeljak 13.2. Opštih uslova, ima mogućnost da uloži reklamaciju Trgovcu u formi koju Trgovac objavljuje na svom web sajtu. Nakon uložene reklamacije, ukoliko Potrošač nije zadovoljan Trgovčevim postupanjem i ishodom, pre nego što se obrati nadležnom sudu u Republici Srbiji, ima mogućnost da pošalje Ministarstvu unutrašnje i spoljne trgovine predlog za pokretanje postupka vansudskog rešavanja spora, elektronski ili u pisanom obliku poštom. Nakon prijema Potrošačevog predloga, Ministarstvo će isti proslediti telu za vansudsko rešavanje potrošačkog spora koje je najbliže mestu prebivališta Potrošača ili telu za koje Ministarstvo proceni da će najefikasnije rešiti predmetni spor. Učestvovanje u navedenom postupku vansudskog rešavanja potrošačkog spora predstavlja za Trgovca obavezu, a za Potrošača mogućnost. | If the Consumer is not satisfied with the goods, i.e. with the delivery of the goods for one of the reasons stated in section 13, subsection 13.2. of the Terms and Conditions, has the possibility to lodge a complaint with the Merchant in the form that the Merchant publishes on its website. After filing a complaint, if the Consumer is not satisfied with the Merchant’s actions and the outcome, before turning to the competent court in the Republic of Serbia, he has the option to send the Ministry of Internal and Foreign Trade a proposal for initiating an out-of-court settlement procedure, electronically or in writing by post. After receiving the Consumer’s proposal, the Ministry will forward it to the body for out-of-court settlement of consumer disputes that is closest to the Consumer’s place of residence or to the body that the Ministry estimates will most effectively resolve the dispute in question. Participating in the aforementioned out-of-court settlement of a consumer dispute is an obligation for the Merchant, and an opportunity for the Consumer. |
Nadležno telo za vansudsko rešavanje potrošačkog spora mora biti neutralno, nezavisno i nepristrasno, a u obavezi je da o opravdanosti dostavljenog predloga odluči u roku od petnaest dana. Nakon što nadležno telo odluči da je podnet predlog opravdan, na brz, efikasan i poverljiv način će nastojati da pronađe konstruktivno i kompromisno rešenje za Trgovca i Potrošača. | The competent body for out-of-court settlement of consumer disputes must be neutral, independent and impartial, and is obliged to decide on the justification of the submitted proposal within fifteen days. After the competent body decides that the submitted proposal is justified, it will try to find a constructive and compromise solution for the Trader and the Consumer in a fast, efficient and confidential manner. |
U svakom slučaju, po završetku navedenog postupka, ukoliko je Potrošač i dalje nezadovoljan ishodom, ima mogućnost da se obrati stvarno i mesno nadležnom sudu u Republici Srbiji. | In any case, after the completion of the mentioned procedure, if the Consumer is still dissatisfied with the outcome, he has the possibility to turn to the competent court in the Republic of Serbia. |
21. PRAVO NA IZMENU OPŠTIH USLOVA | 21. RIGHT TO AMEND THE TERMS AND CONDITIONS |
KADU zadržava pravo da u svakom trenutku pregleda, analizira i izmeni Opšte uslove. | KADU reserves the right to review, analyze and amend the Terms and Conditions at any time. |
Potrošač podleže pravilima Opštiih uslova koji su na snazi u trenutku u kom koristi veb-sajt ili vrši porudžbinu, osim ukoliko prema zakonu, drugom propisu ili odluci organa vlasti KADU mora retroaktivno da izvrši promene u navedenim pravilima, odnosno Opštim uslovima ili Pravilima i Politikama privatnosti. U navedenom slučaju, eventualne promene će uticati i na porudžbine koje je Potrošač prethodno učinio. | The Consumer is subject to the rules of the Terms and Conditions that are in force at the time he uses the website or places an order, unless according to the law, another regulation or the decision of the authorities, KADU must retroactively make changes in the said rules, i.e. the Terms and Conditions or the Rules and Privacy Policy. In the aforementioned case, any changes will also affect the orders previously placed by the Consumer. |
22. VAŽEĆE ZAKONODAVSTVO I SUDSKA NADLEŽNOST | 22. APPLICABLE LAW AND JURISDICTION |
Opšti uslovi se tumače, regulišu i kontrolišu u skladu sa pozitivnim propisima Republike Srbije, a isto se odnosi i na korišćenje KADU-ovog veb-sajta i zaključenje ugovora za kupovinu proizvoda. | The Terms and Conditions are interpreted, regulated and controlled in accordance with the applicable laws and regulations of the Republic of Serbia, and the same applies to the use of KADU’s website and the conclusion of contracts for the purchase of products. |
Za sve što nije predviđeno Opštim uslovima, primenjuju se odredbe Zakona o obligacionim odnosima, Zakona o trgovini, Zakona o zaštiti potrošača, Zakona o elektronskoj trgovini, Zakona o PDV-u i drugih pozitivnih propisa Republike Srbije. | For everything not provided for in the Terms and Conditions, the provisions of the Law on Contracts and Torts, the Law on Trade, the Law on Consumer Protection, the Law on Electronic Commerce, the VAT Law and other positive regulations of the Republic of Serbia apply. |
Svi sporovi koji nastanu iz ili u vezi sa korišćenjem veb-sajta ili navedenih ugovora, rešavaće se pred nadležnim sudovima Republike Srbije. | Any dispute arising from or in connection with the use of the website or mentioned agreements, shall be settled before the competent courts of the Republic of Serbia. |
Ukoliko ugovor sklapa lice koje je Potrošač, ništa iz ovog odeljka neće uticati na prava koja Potrošaču stoje na raspolaganju u skladu sa pozitivnim propisima Republike Srbije u ovoj oblasti, uključujući i pravo na alternativno rešavanje potrošačkog spora kako je opisano iznad. | If the agreement is concluded by a person who is a Consumer, nothing in this section will affect the rights available to the Consumer in accordance with the applicable regulations of the Republic of Serbia in this area, including the right to alternative consumer dispute resolution, as described above. |
